    UPDATE: On June 24, the Supreme Court overturned Roe v. Wade — eliminating the constitutional right to an abortion which was upheld by the court for nearly half a century. 

    The decision will likely lead to total bans on the vital procedure in at least 26 states, mostly in the Midwest, South, and parts of the West. The end of Roe could also invigorate anti-abortion advocates to pursue restrictions even in states where it would still be still legal.

    In his concurrence of the decision, Justice Thomas urged the court to take it a step further by saying SCOTUS should review, "all of its substantive due process decisions." This would include settled law like the right to contraception, legalized same-sex marriage, and other 14th Amendment rights.

    Without Roe, pregnant people's bodies will become sites for criminal suspicion and policing, and not just for those seeking an abortion. Black women, trans, and non binary folks, poor people, and people in rural communities are some of the most vulnerable. 

    But we can still fight back. State and local officials still hold the power to decide when an abortion is permitted and remove the fear that an abortion or any other pregnancy outcome could result in a prison sentence. That’s why we’re fighting to stop criminalization where it starts—at the local district attorney's office.

    District attorneys represent one of the few lines of defense against this attack on bodily autonomy and it's because they have immense discretion over whether or not to charge someone with a crime. By demanding prosecutors use their discretion to keep law enforcement out of health decisions, we can make it just a little bit safer for pregnant people caught in this widespread attack on reproductive freedom.

    As a prosecutor, you have an opportunity to take the right step in enforcing full humanity, dignity, and autonomy for pregnant people. 

    We are calling on you to make a commitment to refuse to criminalize pregnancy based on pregnancy outcomes. Because we believe that no one should be forced to undergo threat of arrest and incarceration because of an abortion, miscarriage, stillbirth, or any other outcome. 

    You have the power to intervene and get ahead of potential criminalization by committing to exercise your discretion and refuse to prosecute based on pregnancy outcomes. 

    Here are the demands: 

    • Firm commitment to not prosecute abortion as well as other pregnancy outcomes and a public stance reaffirming this position. 
    • A declination policy that ensures child-bearers will not be prosecuted for their pregnancy outcomes and that feticide laws will not be used as a proxy for punishing pregnancy loss, including but not limited to:
      • Refusing to prosecute pregnant people related to miscarriages, stillbirths, or any form of pregnancy loss. 
      • Refusing to prosecute pregnant people related to actions during pregnancy, including medically-assisted or self-managed abortion, drug use/possession/distribution during pregnancy where the fetus, embryo, or fertilized egg is the alleged recipient, attempted suicide, fighting, or car accidents.

    Now is the time for you to take this monumental step toward doing what’s right for our communities. The time for you to act is now by saying NO to criminalizing pregnancy.
