    No New Data Centers: Demand A Moratorium Now!

    While tech billionaires rake in AI profits, Black communities are being forced to bankroll the boom. 

    It’s playing out in real time in Memphis, where Elon Musk’s company, xAI, is being sued over a massive new AI data center that was approved without proper permits. Then, this week, the Trump administration intervened in the case to try to help Musk get the lawsuit dismissed.

    The message is clear: billionaires get protection while Black communities pay the price.

    Color Of Change is working alongside partners to fight back on the ground in Memphis, while also building a national movement demanding a moratorium on new data center approvals. Sen. Bernie Sanders (I-Vt.) and Rep. Alexandria Ocasio-Cortez (D-N.Y.) introduced The Artificial Intelligence (AI) Data Center Moratorium Act to stop the expansion of these data centers until we have a framework to address the harm AI poses to our society, and now we need to overwhelm Congress with support.

    What is happening in Memphis is not an isolated incident.

    Across the country, tech companies are racing to build enormous AI data centers to power tools like ChatGPT, Grok, Gemini, and other artificial intelligence products. These facilities require staggering amounts of electricity and water. To meet demand, utilities are proposing new power plants, expanding fossil fuel infrastructure, and seeking massive rate increases from regulators.

    Last year alone, electric utilities requested more than $29 billion in rate hikes — double what they sought the year before.

    Tech giants are not building their infrastructure just anywhere. They are moving into predominantly Black, economically disinvested, and politically underserved areas like Memphis, Tennessee, Prince William County, Virginia, Forest Park, Georgia, and Fairfield County, South Carolina.

    This is environmental racism. Residents are reporting rising utility bills, growing concerns about air quality, and strain on local water systems. Meanwhile, tech executives and utility shareholders continue collecting profits. Communities across the country are fighting back. Congress must act now. We demand a moratorium on new data centers until guardrails can be put in place.
